The Tamil Nadu government has said that the Nayanthara-Vignesh Sivan couple has not violated the rules in the case of surrogate mother.

In such a situation, many questions and controversies kept coming up regarding the surrogate mother. Minister M. Subramaniam had recently constituted a three-member committee headed by the Joint Director of Health to look into the issue of surrogacy. The report of the committee was released today.

According to reports on social media, a popular film actress from Chennai has given birth to twins through a surrogate mother. It is said that Athambathiyar had a child only after four months of marriage.

After this news, a high level inquiry committee was constituted by the Director, Medical and Rural Welfare on 13.10.2022. On investigation, it was found that Athampathiyar gave birth to the child through artificial insemination technique and surrogacy at a private hospital in Chennai.

Direct questioning was also done by the team at the hospital and the treating doctor and the doctors who treated the surrogate during the delivery. The following study notes are reported in further investigation of the vaccine.

In this investigation, it was revealed that the age of the intending couple and the surrogate mother was done as per the Indian Institute of Medical Research (ICMR) guidelines for artificial insemination techniques and surrogacy.

Investigation revealed that the surrogate mother was of eligible age and was married with a living child as per section 3.10.5 of ICMR guidelines. A registration certificate was submitted by the hospital stating that the marriage of the interested couple took place on 11.03.2016. The authenticity of the marriage registration certificate is verified by the registration department.

As per section 3.16.2 of the ICMR guidelines, the medical certificate regarding surrogacy of the above couple has been submitted to the Screening Committee. On questioning the doctor who treated the couple at a private hospital, he said that he had given treatment in 2020 on the basis of a referral letter issued by their family doctor. When asked about the family doctor’s address, it was told that he has been transferred and when he was contacted, the phone numbers were not in use. Further investigation revealed that the doctor had gone abroad, so the team did not examine the family doctor.

The patient treatment records relating to hysterectomy were not maintained properly by the hospital. In August 2020, oocytes and sperm were collected and embryos were developed and stored in hospital cryopreservation and a surrogacy contract was signed in November 2021. In March 2022, the eggs were implanted in the surrogate’s uterus and the babies were reportedly given birth in October.

Under the Artificial Fertilization Technology Act, it is necessary to be a relative of the surrogate mother. But prior to this act the ICMR guidelines had a mechanism for non-relatives to act as surrogates and provide payment only for essential expenses. During the investigation, the surrogate mother was undergoing antenatal care at a private hospital in Chennai. The twins were delivered by the caesarean section, while the fetuses were fully developed. The children have been handed over to the willing couple on 09.10.2022.

In this investigation, the committee found the following deficiencies in the private hospital. As per the ICMR guidelines, the hospital should maintain proper records of the treatment given to the couple and the medical condition of the surrogate mother. But the documents in this regard are not maintained properly in the hospital, so notice has been sent that why artificial insemination centers of private hospital which do not follow the above guidelines properly should not be closed temporarily. This is stated in the report.
